By submitting a film or trailer to FABA Films, the filmmaker confirms that they own all necessary rights, including music, footage, and other copyrighted material, or have obtained proper licenses. The filmmaker agrees to indemnify and hold harmless FABA Films from any claims, damages, or legal action resulting from the use of unlicensed or infringing content.
FABA Films respects the intellectual property rights of others and expects all filmmakers and contributors to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following policy for addressing copyright infringement claims on our streaming platform and festival content.
🔹 Reporting Copyright Infringement
If you believe that your copyrighted work has been used on our website or platform in a way that constitutes copyright infringement, please send a written notice to our designated Copyright Agent with the following information:
Your full name, mailing address, email address, and phone number.
A description of the copyrighted work you claim has been infringed.
The exact URL or description of where the alleged infringing material is located on our site.
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
Your physical or electronic signature.

🔹 Counter-Notice Procedure
If you believe your content was removed by mistake or misidentification, you may send a written counter-notice containing the following:
Your name, address, and contact information.
A description of the content that was removed and its URL before removal.
A statement, under penalty of perjury, that you believe the content was removed in error.
A statement that you consent to the jurisdiction of the federal district court in your district and will accept service of process from the person who filed the original DMCA notice.
Your physical or electronic signature.
Upon receipt of a valid counter-notice, we may restore the material unless the original complainant files a court action against you within 10 business days.
🔹 Repeat Infringers
FABA Films may terminate the accounts or submissions of users who are repeat infringers of intellectual property rights.
