Faba Films – Copyright Takedown Policy

Faba Films respects intellectual property rights and expects everyone who submits, uploads, publishes, or shares content through our services to do the same.

This policy applies to all content made available through Faba Films, including films, trailers, series, episodes, podcasts, audiobooks, eBooks, manuscripts, scripts, poems, photographs, artwork, cover images, music, audio recordings, promotional materials, and user posts. It covers our website, Roku channel, mobile applications, and other Faba-operated services, including associated festival and promotional activities.

Content ownership and permissions

By submitting content, you represent that you own or have obtained the rights, licenses, and permissions necessary for the uses you authorize Faba Films to make of it. This includes rights in any incorporated music, recordings, footage, photographs, illustrations, text, and other protected material.

You remain responsible for your submissions. To the extent permitted by applicable law and your agreement with Faba Films, you agree to indemnify and hold harmless Faba Films from third-party claims, damages, and reasonable legal expenses arising from your infringement of intellectual property rights or breach of these representations. This provision does not exclude liability or rights that cannot lawfully be excluded.

Reporting copyright infringement

If you are a copyright owner or an authorized representative and believe that content available through Faba Films infringes your copyright, send a written notice containing:

  1. Your contact information: Full name, mailing address, telephone number, and email address. Include the copyright owner’s name if you are acting on their behalf.

  2. Identification of the copyrighted work: Describe the work allegedly infringed. If multiple works are covered, provide a representative list. Links to authorized copies may help but are not required.

  3. Identification of the reported material: Identify the material you want removed or access disabled, and provide information reasonably sufficient for us to locate it. Include specific Faba URLs where available. For content on Roku or mobile apps without a shareable URL, provide the title, creator, episode or chapter, and relevant timestamps or screenshots.

  4. A good-faith statement: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

  5. An accuracy and authority statement: “The information in this notification is accurate, and, under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

  6. Your physical or electronic signature.

Send notices to:

Faba Films - Copyright Notices
Email: submissions@fabafilms.com
Subject: Copyright Takedown Notice

We review notices and act expeditiously to remove or disable access to material when appropriate under applicable law. We may request additional information and notify the affected uploader. We may share the notice and relevant contact information with that uploader as necessary to address the claim.

Counter-notice procedure

If your content was removed or disabled because of a mistake or misidentification, you may send a written counter-notice to the email address above containing:

  1. Your physical or electronic signature.

  2. Identification of the removed material and its location before removal.

  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.

  4. Your name, address, and telephone number.

  5. A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located, or, if your address is outside the United States, any judicial district in which Faba Films may be found.

  6. A statement that you will accept service of process from the original complainant or their agent.

We will forward a qualifying counter-notice to the original complainant. Under the DMCA process, we will restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notice, unless our designated agent first receives notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity.

Restoration under this process does not prevent restrictions based on an independent violation of our terms or another lawful basis.

Repeat infringement and misuse

Faba Films maintains a policy providing for termination, in appropriate circumstances, of accounts belonging to repeat infringers. We may also restrict uploads or remove infringing submissions.

Knowingly making material misrepresentations in a copyright notice or counter-notice may result in liability under applicable law. Consider whether the use is authorized by the owner or by law, including fair use, before submitting a notice.

Use this form to report copyright infringement involving content available through Faba Films. Submit a request only if you own the copyright or are authorized to act for its owner.
